In 2025 the FTC fined accessibility-overlay vendor accessiBe $1M for falsely claiming its AI widget made websites WCAG-compliant, and for disguising paid reviews as independent — amid 1,000+ US lawsuits targeting overlay-only sites.
AccessiBe, an Israeli accessibility-technology vendor, sold accessWidget, an AI-powered browser overlay marketed to website owners as an instant fix for legal accessibility risk. The company advertised that the tool could make a website compliant with a share of WCAG requirements immediately and complete WCAG 2.1 AA compliance within 48 hours through an automated AI process, without code-level remediation.
On January 3, 2025 the U.S. Federal Trade Commission filed a complaint alleging these compliance claims were false or unsubstantiated, and that accessiBe had paid for and disguised promotional articles and reviews as independent third-party endorsements. The FTC's final consent order, approved 3-0 on April 22, 2025, requires accessiBe to pay $1 million and permanently bars it from claiming that any automated product can make or keep a website WCAG-compliant unless it holds competent evidence, and from misrepresenting paid endorsements as independent.
The case landed alongside independent evidence that overlay-only remediation correlates with continued legal exposure rather than reduced risk: compliance-tracking firm Compliapoint recorded overlay-equipped sites in 22.6% of 2025 US ADA digital-accessibility lawsuits (456 of roughly 2,000 filings), with over 150 such filings in some single months during the first half of 2025. More than 800 accessibility professionals and disability organisations have separately signed the public 'Overlay Fact Sheet' statement documenting how overlays can interfere with screen readers and other assistive technology. The practice worth replicating here is the enforcement model itself — evidence-based, outcome-focused scrutiny of accessibility-compliance marketing claims — not the audited product.
