Context

Portugal's public administration created the Technical Unit for Legislative Impact Assessment (UTAIL), later folded into PLANAPP (the Centre for Planning, Policies and Foresight of Public Administration), tasked with assessing the impact of legislative proposals before they become law. Between November 2019 and June 2022, this unit ran IA2AI ("Avaliação de Impacto e Inteligência Artificial"), a project to build an application that automatically checks legislative impact assessments and compares alternative drafts, aimed chiefly at estimating administrative costs.

Objectives

Building on IA2AI, develop AI4IA — a prototype that scans transposed European legislation and uses AI/NLP to automatically flag administrative burdens and detect "gold-plating" (over-implementation) introduced during the transposition of EU directives into Portuguese law.

Activities

PLANAPP partnered with NOVA Information Management School (NOVA IMS) and the European Commission's DG REFORM, funded through the EU Technical Assistance Instrument (TAI). Final results were presented at NOVA IMS on 20 June 2024, coordinated by Professor Pedro Simões Coelho, with NOVA IMS describing it as deployed by the Portuguese state and "the first tool worldwide" to combine automated burden-detection and gold-plating checks. A follow-on programme, AI4IA@EU, also supported conferences with the Inter-American Development Bank on regulatory-cost AI tools for Brazil and Paraguay.

Conclusions

Despite the "world first" framing, none of the public materials from PLANAPP, NOVA IMS or DG REFORM disclose how many legislative proposals the tool has screened, how many real burdens or gold-plating instances it identified, its detection accuracy, or measured time/cost savings versus manual review — the claim of deployment rests on institutional press material rather than an independent audit or published dataset. This is a genuine, multi-source-documented initiative with a five-year track record (2019–2024), but it remains evidence-thin rather than a proven, quantified success.
