Description

With the aim of advancing in the achievement of the real and effective exercise of the constitutional principle of equality, this Organic Law introduces substantial modifications in the legal system in order to delve into this effective realization of the equality of men and women in various spheres, and essentially in the decision-making spheres of political and economic life.
In fact:
- This law is issued in accordance with the provisions of article 149.1.1, 6, 11, 13 and 18 of the Spanish Constitution, which attributes to the State exclusive competence over the regulation of basic conditions that guarantee the equality of all Spaniards in the exercise of
rights and in the fulfillment of constitutional duties; commercial legislation; the bases of
credit management, banking and insurance; the bases and coordination of the general planning of economic activity; and the bases of the legal regime of public administrations
respectively.
- By means of this law, Directive (EU) 2022/2381, of the Spanish Parliament, is incorporated into Spanish law. European Parliament and of the Council, of November 23, 2022, regarding a better gender balance between administrators of listed companies and related measures.

Why it's a good practice: This initiative should be considered a good practice because it is an attempt to change things in terms of equality from the government and the law, which means that these changes are implemented in society with more effectiveness and efficiency.

Since the objective is to regulate female representation in positions of power, we would say that it is related to political power.
