Description

Directive (EU) 2023/970 had a transposition deadline of 7 June 2026, which Luxembourg has not met according to reports from around June 2026.
Sources conflict on progress: a CMS Luxembourg update says no draft bill had been published and that the Ministry of Labour did not expect draft legislation before the second half of 2026, while another report citing the Ministry in April 2026 says a first draft had been prepared but still had to be discussed with the social partners before going to the Chamber of Deputies.
The Ministry said it wants to balance effective protection of workers' rights against excessive administrative burdens on businesses.
Existing law: equal pay for women and men is already in the Labour Code, with sanctions for employers who fail to guarantee it, and elected staff representatives receive gender-disaggregated workforce statistics.
The Directive would add the right to know salary ranges before interview, a ban on pay-history questions and internal pay-gap reporting for larger employers. Paperjam notes that a non-transposed directive does not bind private parties directly but can influence interpretation of national law.
Evidence caveat: this is a status case with no outcome data; the position may have changed since mid-2026.
