Contexto

This draft Spanish Organic Law aims to advance the real and effective exercise of the constitutional principle of equality between women and men, introducing modifications to the legal system, particularly in political and economic decision-making spheres.

Objetivos

To regulate equal representation of women and men in governing/decision-making bodies, grounded in Article 149.1 of the Spanish Constitution (state competence over basic equality conditions, commercial legislation, credit/banking/insurance bases, coordination of general economic planning, and the legal regime of public administrations); and to transpose EU Directive 2022/2381 on improving the gender balance among directors of listed companies into Spanish law.
